Texas Discovery Rule for Mesothelioma

Texas applies the discovery rule to latent disease cases like mesothelioma. This means the 2-year clock begins when the patient knew or reasonably should have known of the injury — in practice, the date of the confirmed mesothelioma diagnosis. The statute does not begin running when asbestos exposure occurred (which could be 20–50 years earlier).

The Texas Supreme Court has affirmed the discovery rule for asbestos cases, recognizing that it would be fundamentally unjust to hold that a latent disease like mesothelioma was “known” at the time of microscopic cellular injury decades before any symptoms appear.

Texas Wrongful Death Claims

If a mesothelioma patient dies before filing a lawsuit, surviving family members may file a wrongful death action under Tex. Civ. Prac. & Rem. Code §71.002. The wrongful death filing deadline is 2 years from the date of the patient’s death. Wrongful death claims are in addition to, and separate from, any claims the patient filed or could have filed during their lifetime (survival claims).

Where Texas Mesothelioma Cases Are Filed

Texas mesothelioma cases are most commonly filed in:

  • Harris County District Court (Houston) — the primary venue for Houston Ship Channel, Beaumont/Golden Triangle, and Galveston County cases; large asbestos docket with experienced judges
  • Jefferson County District Court (Beaumont) — handles Golden Triangle / Port Arthur cases; historically favorable to plaintiffs
  • Southern District of Texas (Federal) — federal venue for cases meeting diversity requirements

Venue selection is a strategic decision made by your attorney based on your specific case facts, the defendants named, and current court conditions.

Trust Fund Claim Timelines in Texas

Trust fund claims have deadlines separate from the Texas state court deadline. Most asbestos bankruptcy trusts allow claims within 3–5 years of diagnosis, and some have no hard cutoff. However, trust fund payment percentages can decrease as assets are depleted, so earlier filing is always better. Importantly, the Texas 2-year lawsuit deadline does not affect trust fund claim eligibility.

The Texas discovery rule clock starts when you “knew or reasonably should have known” of the disease. If your diagnosis involved multiple physician consultations before a definitive pathology confirmation, your attorney will analyze the timeline carefully to establish the most defensible start date for the statute of limitations. In cases where the exact diagnosis date is disputed, litigation over the limitations issue itself is possible. This is one reason to contact an attorney promptly after any suspected mesothelioma diagnosis, even before a full diagnostic workup is complete.
