Kanawha County Circuit Court in Charleston handles most West Virginia asbestos cases. Some federal cases are filed in the Southern District of West Virginia.
Black Lung & Asbestos: Many West Virginia coal miners with mesothelioma also qualify for Black Lung benefits through the Department of Labor. These are completely separate from asbestos civil claims and can be pursued simultaneously. The Black Lung Disability Trust Fund provides benefits regardless of any lawsuit outcome.
