Union Carbide Institute & the Bhopal Connection

Union Carbide’s Institute, West Virginia plant is best known as the site of the only significant chemical plant accident in U.S. history following the 1984 Bhopal disaster. But long before that, the Institute plant — which manufactured methyl isocyanate (MIC) and pesticides — exposed workers to asbestos through insulated process equipment, reactors, and piping throughout the 1940s, 50s, and 60s.

Workers at the Institute plant who were diagnosed with mesothelioma have filed claims against both the asbestos product manufacturers who supplied insulation materials and (in some cases) Union Carbide / Dow Chemical as the facility operator. West Virginia’s Kanawha County Circuit Court handles state asbestos litigation.

DuPont Belle: A Century of Chemical Exposure

DuPont has operated its Belle, West Virginia works since 1926, producing a range of industrial chemicals including methanol, hydrogen, and agricultural chemicals. The Belle facility used asbestos insulation on virtually all process equipment through the 1970s, and maintenance workers — particularly pipefitters, insulators, and boilermakers — had extensive asbestos contact during construction and turnaround maintenance.

Yes. Workers at Union Carbide Institute, DuPont Belle, FMC South Charleston, Monsanto Nitro, and other Kanawha Valley plants can file claims against asbestos product manufacturers within West Virginia’s 2-year statute of limitations from the date of mesothelioma diagnosis. Many workers at these facilities also qualify for multiple asbestos trust fund claims simultaneously, often totaling $200,000–$1.5 million across all applicable trusts, independent of any lawsuit.

Yes. West Virginia coal miners who develop mesothelioma can file asbestos civil claims against equipment manufacturers and contractors, completely separate from any Black Lung program claims. Black Lung benefits through the Department of Labor and asbestos civil claims can be pursued simultaneously. An experienced attorney can identify both compensation streams. Many miners have received significant combined compensation from both channels.
